Augusta/ Aiken Dining Club, LLC believes so much in the value of our program, you the Buyer have thirty (30) business days from the beginning of benefit period (activation) to cancel this contract. Any free period offered by promotion, contract, or other agreement will not extend this 30 day money back guarantee. No cash refunds of any type will be honored past this time period. To cancel, mail a certified letter postmarked within 30 business days of purchase of transaction or hand deliver a cancellation letter to: Augusta/Aiken Dining Club, LLC, 339 Fury’s Ferry Road, Suite 3, PMB 199, Martinez, Georgia 30907. Cancelations may also be made online at AugustaAikendiningClub.com.
NOTICE: State Law requires that we inform you that you (the buyer) are paying for this membership, per agreement, in advance, be aware you are paying for future benefits or services and may risk loss of your money or benefits in the event any of the participating restaurants should cease to conduct business or no longer honor their contractual agreement. In the event this may happen, you (the buyer) hereby release, indemnify, and hold harmless the participating restaurant(s) or Augusta/ Aiken Dining Club, LLC.
Payment in full: If a buyer desires to pay in full for program discounts or future benefits and services, client’s execution of this agreement hereby constitutes a written request to make such a payment in full without refund or recourse beyond the 30 day money back guarantee.
Monthly Payments: Buyer agrees to make payments monthly until September 2010. Payment date will be each month on calendar day of initial activation without notification. Charge will show up as AADC on your credit statement. Buyer may cancel at any time, effective on the date of request and without refund. Cancelation request may be made online at AugustaAikendiningClub.com.
Buyers Default (Month to Month): Buyer shall be deemed in default of this Agreement upon failure to comply with any of the terms and conditions of the Agreement, including but not limited to the obligation to make any payment as and when due. Upon default, Augusta/Aiken Dining Club, LLC will consider non-payment as a request for cancellation without refund and will not seek collection.
Successors and Assignees: Buyer agrees that all terms and conditions of Agreement shall be binding upon the heirs, personal representatives, lawful successors and assignees of buyer, and anyone claiming by or through Buyer.
Enforceability: The parties agree that if any portion of this agreement is declared void and unenforceable such provision or portion shall be deemed severed from this agreement which shall otherwise remain in full force and effect.
Governing Law: this agreement shall be governed and enforced in accordance with the laws of the State of Georgia. In the event litigation is necessary to enforce any of the terms and conditions of this agreement, Augusta/Aiken Dining Club, LLC and buyer agree that the venue for such court action shall exclusively be in Richmond County, Georgia.
Attorney fees: In the event that either party finds it necessary to commence litigation or other court action to enforce the terms and conditions of this agreement the prevailing party in such litigation or court action shall be entitled to receive their attorney’s fees, court cost, and other charges from the party as part of any ruling, determination or judgment.
Rules and Regulations: The buyer understands the Augusta/Aiken Dining club Membership Card or its benefits are non-transferable without the consent of Augusta/Aiken Dining club, LLC. Buyer agrees to indemnify and hold harmless Augusta/Aiken Dining club, LLC for any injury, sickness or other liability arising from the use of benefits provided by the Augusta/Aiken Dining club, LLC. As part of your membership, you agree to receive regular emails from Augusta Aiken Dining Club. |
